Please review the following terms and conditions, which govern the use of the website meneighbour.com.

1. General Remarks

The website meneighbour.com (the “Website”) is owned and operated by JT TechnoSoft Inc. (the “Site Operator”) to provide a social networking platform, as described below, and other services.

This document sets out a legal agreement (the “Agreement”) that governs the use of the Website. Use of the Website constitutes agreement to follow and be bound by this Agreement.

This Agreement includes the Privacy Policy set out at https://www.meNeighbour.com/privacy-policy , which outlines the Site Operators policies relating to the collection and use of personal information.

The Site Operator reserves the right to modify this Agreement at any time in its sole discretion without prior individual notice. Any modifications to this Agreement will be posted on this website, and subsequent use the website constitutes an agreement to be bound by and comply with these modifications. Please review the Agreement with each use of the website. This Agreement was last modified on the “last updated” date that appears at the top of the Agreement. If you do not agree to these terms, please do not use this website.

The Website is intended solely for personal, non-commercial use, and is provided for informational purposes only.

The Website, and all materials on the Website, including text, images, illustrations, graphics, designs, icons, software, applications, music and sound files, photographs, commercials, video clips and other materials, and their selection and arrangement, and the copyrights, trademarks, domain names, trade dress and/or other intellectual property in such materials, are owned, or licensed by the Site Operator, with all rights reserved. The materials on the Website are protected by copyright and other laws. The materials on the Website may not be sold, modified, altered, copied, reproduced, extracted, displayed, distributed, or otherwise used in any way for any public or commercial use. Any reproduction of materials on the Website for personal, non-commercial use must retain all proprietary notices.

2. User Registration

In order to use some of the features offered on the Website, a user must register with the Site Operator for a user account (“Registered User”), which is a personal, non-commercial account. To create an account, a Registered User must provide the required identification and contact information, including an email address (the “Registered Email Address”). The Site Operator will validate the provided email address. The Registered User must provide complete and accurate information. A Registered User may not create multiple user accounts. The Registered User is responsible for maintaining the confidentiality of its account password and the accuracy of information about its account. The Registered User is also responsible for all activities that occur in connection with its account. The Registered User agrees to notify the Site Operator immediately of any unauthorized use of its account. The Site Operator reserves the right to temporarily or permanently terminate a Registered User’s account at any time for any or no reason.

Alll the information received from Registered Users are stored on servers located in Canada.

Email Communication: By creating a user account, the Registered User is explicitly agreeing to receive certain communications from the Site Operator in connection with its services and the Website. The communication may include information about other products and services offerred by the Site Operator.

Friend's Email Address: A Registered User is permitted to submit a friend's email address to the Website in order to invite friends to join the user base of the Website. By providing a friend's email addresses to the Website for an invitation, the Registered User is granting the Site Operator permission to forward an invitation to the provided email address on behalf of the Registered User and is also agreeing to assume complete responsibility of such invitation and the email address use on the Website. While the Site Operator uses the friend's email address only for invitation and retains it in the database, the Registered User is responsible for the friend's email address use on the Website.

3. User Information and Posted Content

The Site Operator provides various services at the Website, including the display of one or more information pages containing the information about Registered Users (“User Page”). Each User Page is associated with a Registered User. A User Page displays the information of a Registered User that includes Registered User's name, city/town, work, profession, marital status, gender and age-group. The street address provided by the Registered User as part of the registration is excluded from any public display on the Website and is used only to calculate a search radius for the Registered User to be listed and found in a local neighbourhood.

The Registered User is responsible for providing its user information to the Site Operator, including text-based information, images and video links. The Site Operator makes no claims or promises about the quality, accuracy, security, safety, or reliability of the information on a User Page. The Registered User assumes all risks associated with the information displayed on User Page or any other page on the Website.

By registering at the Website, the Registered User is permitted to use the Website as a social media platform where Registered Users can share information, and post a message, comment, picture or video, and communicate with other Registered Users on the Website in a friendly, responsible manner.

The Registered User is responsible for the content it provides to the Site Operator for User Page, Message Board, Business Listing and any other page on the Website. The Registered User represents that it owns or has the necessary permissions to use and authorize the use of the text-based information and the image and the video link provided to the Site Operator to display on the Website.

The Registered User is responsible for what it posts as a content on the Website. Any content, including text based information, images and video links, posted by the Registered User is not private or secure information and may be visible to other users on the Website and its network.

The Registered User is responsible how its information and posted content will be visible and available to other users of the Website.

The Registered User must adhere to local rules and regulations, and laws when posting a content on the Website. The Registered User must not post any personal, secure or financial information that infringe any one's rights.

The Registered User assumes all risks associated with user pages and posts, including any reliance on their quality, accuracy, or reliability. The Site Operator makes no claims or promises about the quality, accuracy, security, safety, or reliability of the information available on or accessible through the Website.

The Registered User may be exposed to liability if, for example, the user posted content contains material that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation. The Site Operator may, at its sole discretion, remove any User Page that contains unsuitable, unlawful or offensive material including the transmission or communication of images or text consisting of ethnic slurs, racial epithets, sexually explicit material, obscenities or any thing else that may be construed as illegally harassing or offensive to others based on an individual’s race, national origin, religion, sex, sexual orientation, color, marital status, age or disability.

The Site Operator may use the User Page and the text-based information and the image and the video link provided by the Registered User in a number of different ways, including publicly displaying it, reformatting it, creating derivative works from it, promoting it, displaying an index to it, and distributing it in connection with the operation of this Website. As such, the Registered User hereby irrevocably grants the Site Operator a world-wide, non-exclusive, royalty-free, transferable right to use the User Page and the text-based information and the image and the video link provided to the Site Operator for any purpose in connection with the operation of this website. The Registered User also irrevocably grants the users of the Website the right to access the User Page, the text-based information and the image and the video link in connection with their use of the Website. Finally, the Registered User irrevocably waives, and causes to be waived, against the Site Operator and its users any claims and assertions of moral rights or attribution with respect to the User Page and the text-based information and the image and the video link provided to the Site Operator, where "use" means use, copy, publicly perform or display, distribute, modify, translate, and create derivative works.

The Site Operator reserves the right to remove, screen, edit, or reinstate text-based information and the image or video link provided by the Registered User from time to time at the Site Operator’s sole discretion and without notice. For example, the Site Operator reserves the right to remove information that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation. The Site Operator has no obligation to retain or provide a Registered User with copies of the provided text-based information and the image and the video link, nor do they guarantee any confidentiality with respect to the provided text-based information and the image and the video link.

The Site Operator does not control the content posted by Registered User and makes no representation or warranty regarding the quality, accuracy, security, safety, or reliability of the information available on or accessible through the Website. The Site Operator has no control over the truth, accuracy, quality, or legality of the information displayed on the Website.

[Edit: 2022-11-27] However, if a content posted by Registered User which is inappropriate or containts unsuitable, unlawful or offencive material as stated in 4. Message Board, the Site Operator may, at its sole discretion, block the content from display and, also block or remove the Registered User from accessing the Website if such offences are repeated.

All user content such as text messages, images, video links posted by Registered User will be deactivated from their display on the Website after six (6) months of their posted date. During the six (6) months deactivation period, the user content can be reactivated to be visible on the Website by contacting the Site Operator via email. After six (6) months of deactivation, or twelve (12) months from the actually posted date, the user content will be removed from our data servers permanently. With the exception to business listings added by users, the user information posted on the Website by a Registered User has only a maximum of 12-month period of life including the active/inactive/reactive period, there will be no grace period and the user will not be able to recover the information after the twelve (12) month period from their posted date. A Registered User whose account is inactive for more than six (6) months will also be deactivated from the display on the Website so the user or its profile would not be visible to the users on the Website. The user account can be reactivated by contacting the Site Operator via email so the user account will be reinstated to be visible and accessible by the Registered User on the Website.

4. Message Board

The Site Operator provides the Website as a social media platform where Registered Users can share text-based information, images, pictures, video links and such, and communicate with other users through message boards. A message board is an information page (“Message Board”) provided by the Website where Registered Users can post, share, comment, reply, review and remark with text-based information, image, picture, video link and such.

Any content, including text-based information, image and video, posted on the Message Board is visible to one or more Registered Users of the Website. The Registered User is responsible for what it posts on Message Board. A Registered User must not post a private or secure information on Message Board.

The Site Operator may, at its sole discretion, remove any content posted on Message Board that contains unsuitable, unlawful or offensive material including the transmission or communication of images or text consisting of ethnic slurs, racial epithets, sexually explicit material, obscenities or any thing else that may be construed as illegally harassing or offensive to others based on an individual’s race, national origin, religion, sex, sexual orientation, color, marital status, age or disability.

5. Child Account and Child User

While the Website is primarily intended for users of 13 and older, it also permits an adult Registered User to create a child user account (the “Child Account”) under its Registered User Email Address.

A Child Account is intended only for a user under the age of 13 (the “Child User”) and is created only under a Registered User account, and is provided with a limited functionality on the Website.

The Registered User, who is using its registered email address for the Child User and Child Account, is a parent of the child user and is the parent Registered User of the Child Account. The parent Registered User is responsible for providing the Child User's information, including the child user name, age-group and gender, to the Site Operator for a Child Account and is also responsible for any risks associated with the display of Child User's information on the Website.

By registering a Child User and creating a Child Account on the Website, the parent Registered User is giving consent to the Site Operator for permitting the Child User to use and access the social media features of the Website. By creating a Child Account under its Registered User email address, the parent Registered User is responsible for all activity of the Child User on the Website.

Being responsible for all activity of the Child Account created under, the parent Registered User can monitor all activity of the Child Account, can access the Child Account as itself the Child User, and, can change and control the Child Account's privacy settings, thus ensuring the Child Account user acts responsibly and respectfully on the Website.

Provided with a limited functionality, a Child User is permitted to access and use only the child-friendly pages of the Website while some pages and features of the Website are not visible or accessible to a Child Account.

While the Website tries its best to provide a safe and secure child-friendly Child Account with a limited social media functionality, the Site Operator strongly recommends the parent Registered User to monitor and control the activity of all its Child Accounts, and ensure the Child User acts responsibly and respectfully in a safe and secure manner. The parent Registered User is all responsible for any and all activity of its Child Accounts on the Website.

The Site Operator reserves the right to determine the maximum number of Child Accounts a Registered User can create under its Registered User account, and may change the minimum or maximum limit at any time at its sole discretion without a notice.

6. Business Listings

The Website permits Registered User to post and display information of a local business in the Local Business page (the “Business Listings Page”). Each business listed in the Local Business page is associated with a Registered User. The Registered User associated with the listed business is assumed to be the owner and/or authorized representative of the listed business, and the Registered User is authorized to use or list the information about the local business, including business name, logo, address, and contact information.

The Business Listings Page is for information purposes only and is not a platform for e-commerce transactions.

The Site Operator has no obligation, but reserves the right, to verify the validity of a listed business or business information provided by the Registered User.

The Site Operator reserves the right to remove, screen, edit, or reinstate text-based information and the image posted on the Business Listings Page from time to time at the Site Operator’s sole discretion and without notice.

The Business Listings Page is visible and accessible only to the Registered Users, but not for Child Accounts, hence the Business Listings Page is not visible or accessible to Child Accounts.

The Business Listings Page shows only the businesses listed from the local Neighbourhood.

7. Bulletin Board / Community Update

Featuring the Website as a social media site, the Site Operator provides a free public notice and information page (the “Bulletin Board”) on the Website for Registered Users of a city, town or municipal region (the “Neighbourhood”).

Bulletin Board is a free public information page provided by the Site Operator for a Neighbourhood and is solely intended for helpful public information such as a local be-aware alert, crime alert, fire alert, etc., posted by local police, fire and other municipal service departments from the Neighbourhood.

Access to the Bulletin Board is permitted upon a Registered User request for the requested Neighbourhood. The Site Operator reserves the right to grant or deny access to Bulletin Board for a Neighbourhood. The permission to post and update on Bulletin Board is granted only to the Registered Users of public service department such as police, fire or municipal service from the Neighbourhood.

The Site Operator may permit only a few or limited number of Registered Users to post on the Bulletin Board for their Neighbourhood. The posted content may include text-based information, picture, image and video for the public information purpose. The Site Operator reserves the right to grant, deny or cancel a permission to access the Bulletin Board any time at its sole discretion.

Access to the Bulletin Board is permitted upon a basic verification of the information provided by Registered User, such as the Registered User's location, official email address at work, work position, and web address of the public service in the Neighbourhood.

Bulletin Board is intended for helpful public information purposes only and not allowed to use for any commercial or political purpose, reason, party or campaign. If any message or content seemed or reported to be abusive or inappropriate, the Bulletin Board for the Neighbourhood may be cancelled and removed immediately at the Site Operator's sole discretion without a notice.

The Site Operator does not guarantee a display of the posted content in time or any time on the Bulletin Board for a Neighbourhood. The Site Operator may, at its sole discretion, decide to not display a post on the Bulletin Board.

The Site Operator makes no claims or promises about the quality, accuracy, security, safety, or reliability of the information on the Bulletin Board.

The Bulletin Board is solely information purposes and not a platform for any commercial or political purposes.

The Registered User, who posted the content, may be exposed to liability if, for example, the posted a content that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.

The Site Operator reserves the right to remove, screen, edit, or reinstate text-based information and the image or video link provided by Registered User for Bulletin Board from time to time at the Site Operator’s sole discretion without a notice.

The Site Operator may, at its sole discretion, remove any Bulletin Board that contains unsuitable, unlawful or offensive material including the transmission or communication of images or text consisting of ethnic slurs, racial epithets, sexually explicit material, obscenities or any thing else that may be construed as illegally harassing or offensive to others based on an individual’s race, national origin, religion, sex, sexual orientation, color, marital status, age or disability.

8. Data Storage and Removal

8.1 Deletion and Termination of Reported Content and Users

The site operator may, at its sole discretion, block or remove a Register User and/or its content that has been reported as inappropriate or not adhering to the Website terms and conditions. The Register User may be removed or blocked from accessing the Website if the Registered User has been reported and found as not adhering to the Website terms and conditions or posting a content that contains unsuitable, unlawful or offensive material including the transmission or communication of images or text consisting of ethnic slurs, racial epithets, sexually explicit material, obscenities or any thing else that may be construed as illegally harassing or offensive to others based on an individual’s race, national origin, religion, sex, sexual orientation, color, marital status, age or disability.

9. Errors, Inaccuracies, and Omissions

Occasionally there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to Product Pages, reviews and other information. The Site Operator reserves the right at any time and its sole discretion and without prior notice to correct any errors, inaccuracies or omissions to the information on the Website.

10. Information Submitted Through the Website

The submission of information through this Website is governed by our Privacy Policy. This Agreement incorporates by reference the terms and conditions of the Privacy Policy.

11. Links to Other Websites and Services

The Website may contain links to other websites that are not maintained, controlled or created by the Site Operator. The Site Operator makes no representations about and has no responsibility for the linked websites, and does not endorse any linked website or the information appearing thereon. Links are provided solely for the convenience and information of this Website's users, and do not imply that the Site Operator endorses, is affiliated with or associated with such linked websites. The Site Operator recommends before using any third party website, review of such website’s own terms of use agreement and privacy policy.

12. Website Security

Subscribers and users are prohibited from violating or attempting to violate the security of this Website, including, without limitation:

accessing data not intended for you, including logging into a server or account which you are not authorized to access,
attempting to probe, scan or test the vulnerability of a system or network to breach security or authentication measures without proper authorization,
attempting to interfere with, disrupt or disable service to any user, host or network, including, without limitation, via means of "denial of service" attacks, overloading, "flooding", "mail bombing" or "crashing",
forging any TCP/IP packet header or any part of the header information in any e-mail or posting,

Violations of system or network security may result in civil or criminal liability. The Site Operator may investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting anyone who is involved in such violations.

13. Right to Change the Website

The Site Operator reserves the right, at any time, and without prior notice, at its sole discretion, to: modify, change, add, delete, restrict, suspend or discontinue this Website or any aspect of this Website (for example, any service, content, account, Product Page, or feature displayed on or offered through this Website, and including access to, or use of the Website); charge fees in connection with the use of this Website; modify and/or waive any fees charged in connection with this Website; and/or offer opportunities to some or all users and Subscribers of this Website. The Site Operator shall not be liable to users or Subscribers or to any third party for any modification, suspension or discontinuance of the Website, or for any service, content, feature or product offered through this Website.

If a Subscriber, Registered User, or other user does not abide by the Agreement, as determined by the Site Operator in its sole and absolute discretion, the Site Operator has the right to and may revoke privileges to use all or a portion of this Website and/or take any other appropriate measures to enforce the Agreement, without warning or liability whatsoever. For example, we may suspend, cancel or terminate access to the Website (or any part thereof), and account.

14. Disclaimer

Without limiting the foregoing, everything on the Website is provided “as is” and “as available” without warranties, representations and/or conditions of any kind, either express or implied, including, without limitation, warranties of title, implied warranties, representations or conditions of business quality, fitness for a particular purpose, or title and non-infringement of intellectual property. The Site Operator does not warrant that this Website or the servers making the Website available are virus free or free of other harmful components, or that the Website and its functions will be uninterrupted or error free, or that defects will be corrected. By providing a directory of Product Pages, information and materials on the Website, the Site Operator does not in any way promise that they will remain available. The Site Operator and its affiliates expressly disclaim any duty to update or revise the content of the Website, although we may modify the content at any time without notice. Use of the Website is at your sole risk, and users and Subscribers assume full responsibility for any costs associated with your use of this Website. The Site Operator and/or its affiliates shall not be liable for any harm, loss or damage of any kind related to your use or misuse of this Website, including, without limitation, in relation to correctness, accuracy, reliability, or otherwise.

15. Indemnification

Subscribers, Registered Users, and other users agree to defend, indemnify and hold the Site Operator harmless from and against any and all claims, damages, loss, costs and expenses, including attorneys' fees, arising from or related to their use or misuse of the Website and/or their breach of any representation, warranty, or other provision of the Agreement.

16. Choice of Law and Jurisdiction.

This Agreement shall be construed in accordance with the laws of Ontario and Canada, as applicable therein, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the Superior Court of Justice or Federal Court of Canada residing in Toronto, Ontario.

17. General

The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of the Site Operator’s right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unlawful, void or unenforceable for any reason, that provision shall be severable, and will not affect the validity and enforceability of all other provisions, which shall remain in full force and effect. This Agreement constitutes the entire agreement between us relating to your use of this Website.

18. Termination

These terms are effective unless and until terminated by the Site Operator. The Site Operator may terminate this Agreement at any time without notice, and accordingly may deny access to this Website, for any reason or no reason. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.
